For what purpose will we process your personal data?
At ALMA EN PENA SL, we will process your personal data collected via the website: www.almaenpena.es or www.almaenpena.com, for the following purposes:
- When subscribing to goods and services offered via www.almaenpena.es or www.almaenpena.com, to maintain the contractual relationship, as well as for management, administration, information, provision, and improvement of the service.

Publishing posts from social networks in the web gallery
To comply with Organic Law 1/1982 of May 5 on civil protection of the right to honor, privacy, family life, and image, as well as Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and Organic Law 3/2018 of December 5 on the protection of personal data and the guarantee of digital rights, ALMA EN PENA, SL requires the user's consent so that in publications where products belonging to the Alma en Pena brand are presented, they may be used and published in one of the galleries on www.almaenpena.es or www.almaenpena .com.
The purpose for which these publications will be processed is solely and exclusively for commercial and advertising purposes for the brand. These images may be used both in the gallery on the website www.almaenpena.es or www.almaenpena.com, and in social media profiles (Facebook, Instagram, etc.). This data will be stored for a period of 5 years.
Alma en pena will request permission to use the images for subsequent publication in the gallery on the website www.almaenpena.es or www.almaenpena.com. Consent will be collected via comments on users' social media profiles by Alma en pena, where consent will be considered granted when the user responds to the comment with the following hashtag: #OuiAlmaenpena. Consent may be revoked at any time in accordance with Article 7 of the European Regulation.

How long are the personal data collected kept?
The personal data provided will be kept for as long as the commercial relationship is maintained or until you request its deletion, and for the period during which legal liabilities may arise for the services provided.

The processing of your data is carried out on the following legal bases, which legitimize it:
- The request for information and/or subscription to the services of ALMA EN PENA, SL, the terms and conditions of which will be made available to you in all cases prior to any contract.

ALMA EN PENA, SL hereby informs you that, as a data host and in accordance with the provisions of Law 34/2002 of July 11 on information society services and electronic commerce (LSSI), it stores for a maximum period of 12 months the information essential to identify the origin of the hosted data and the time when the service began. The storage of this data does not affect the secrecy of communications and may only be used in the context of a criminal investigation or to safeguard public safety, by making it available to judges and/or courts or the ministry that requests it.
The communication of data to State Forces and Agencies will be carried out in accordance with the provisions of the regulations on the protection of personal data.

ALMA EN PENA, SL is the owner of all copyrights, intellectual and industrial property rights, know-how, and any other rights related to the content of the website www.almaenpena.es or www.almaenpena.com and the services offered therein, as well as the programs necessary for its implementation and related information.
The reproduction, publication, and/or use of the content, in whole or in part, of the website www.almaenpena.es or www.almaenpena.com for purposes other than strictly private use is not permitted without prior written authorization.
Intellectual property rights in software
The user must comply with the third-party programs made available to them by ALMA EN PENA, SL, even if they are free and/or accessible to the public.
ALMA EN PENA, SL has the necessary exploitation and intellectual property rights for the software.
The user does not acquire any rights or licenses to the contracted service, the software necessary to provide the service, or the technical information for monitoring the service, with the exception of the rights and licenses necessary to perform the contracted services and only for the duration of those services.
For any action beyond the execution of the contract, the user will need written authorization from ALMA EN PENA, SL, and will be prohibited from accessing, modify, or view the configuration, structure, and files of the servers belonging to ALMA EN PENA, SL, assuming civil and criminal liability arising from any incident that may occur in the servers and security systems as a direct result of negligent or malicious action on their part.
Intellectual property of hosted content
Use contrary to intellectual property legislation of the services provided by ALMA EN PENA SL and, in particular, of:
- Use contrary to Spanish law or infringing on the rights of third parties.
- The publication or transmission of any content that, in the opinion of ALMA EN PENA, SL, is violent, obscene, abusive, illegal, racist, xenophobic, or defamatory.
- Cracks, program serial numbers, or any other content that violates the intellectual property rights of third parties.
- The collection and/or use of other users' personal data without their express consent or in violation of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
- The use of the mail server and domain email addresses to send bulk spam.
The user is fully responsible for the content of their website, the information transmitted and stored, hypertext links, third-party claims, and legal actions relating to intellectual property, third-party rights, and the protection of minors.
The user is responsible for complying with applicable laws and regulations and rules relating to the operation of online services, e-commerce, copyright, public order, and universal principles of Internet use.
The user shall compensate ALMA EN PENA, SL for any expenses incurred by ALMA EN PENA, SL in any case where the user is liable, including legal defense costs and expenses, even in the event of a non-final court decision.
ALMA EN PENA, SL makes backup copies of the content hosted on its servers, but is not responsible for the accidental loss or deletion of data by users. Similarly, it does not guarantee the total replacement of data deleted by users, since such data may have been deleted and/or modified during the period of time that has elapsed since the last backup copy was made.
The services offered, with the exception of specific backup services, do not include the replacement of content stored in backup copies made by ALMA EN PENA, SL, when such loss is attributable to the user. In this case, a fee will be determined based on the complexity and volume of the recovery, always with the prior acceptance of the user.
The replacement of deleted data is only included in the price of the service when the loss of content is due to causes attributable to ALMA EN PENA, SL.
In accordance with the LSSI, ALMA EN PENA, SL will not send advertising or promotional communications byemail orany other equivalentelectronicmeans of communication that has not been previously requested or expressly authorized by the recipients thereof.
In the case of users with whom there is a prior contractual relationship, ALMA EN PENA, SL is authorized to send commercial communications regarding ALMA EN PENA, SL products or services similar to those initially subscribed to by the customer.
In all cases, after proving their identity, users may request that no commercial information be sent to them via Customer Service channels.
